Cancellation and Refund Conditions

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

GENERAL:

By placing an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and distance sales contract presented to you.

Buyers are subject to the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation (Official Gazette: November 27, 2014/29188), as well as other applicable laws, regarding the sale and delivery of the purchased product.

Shipping costs, which are the cost of shipping the product, will be paid by the buyer.

Each purchased product will be delivered to the person and/or organization specified by the buyer within a legal 30-day period. If the product is not delivered within this period, the buyer may terminate the contract.

The purchased product must be returned complete and in accordance with the specifications specified in the order, along with any documents such as the warranty certificate and user manual.

If the purchased product becomes impossible to sell, the seller must notify the buyer in writing within 3 days of learning of the situation. The total price must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

If the Buyer fails to pay for the purchased product or cancels the payment in their bank records, the Seller's obligation to deliver the product is terminated.

PURCHASES MADE WITH UNAUTHORIZED CREDIT CARD USE:

If, after the product is delivered, it is determined that the Buyer's credit card was used improperly by unauthorized persons, and the price of the product sold is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product to the Seller within 3 days, with shipping costs at the Seller's expense.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORSE REASONS:

If force majeure events beyond the Seller's control occur and the product cannot be delivered on time, the Buyer will be notified. The Buyer may request the order to be canceled, the product to be replaced with a similar product, or a postponement of delivery until the obstacle is resolved. If the Buyer cancels the order, if the payment was made in cash, the payment will be paid in cash within 14 days of the cancellation. If the Buyer cancels by credit card, the product fee will be refunded to the bank within 14 days of the cancellation. However, the bank may transfer the payment to the Buyer's account within 2-3 weeks.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

The Buyer must inspect the goods/services covered by the contract before receiving them; they will not accept damaged or defective goods/services (such as those with dents, breaks, torn packaging, etc.) from the courier company. The goods/services received will be deemed undamaged and intact. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal is exercised, the goods/services must not be used. The invoice must be returned along with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER has the right to withdraw from the contract within 14 (fourteen) days without providing any reason. According to Article 15 of the Distance Contracts Regulation, since ring sizes are custom-made for ring orders, there is no right of withdrawal (right of cancellation and return) subject to legal conditions. However, for ring orders specifically for www.eysell.com, cancellations and returns are subject to a 5% deduction. However, there is no right of withdrawal for wedding rings with inscriptions inside.

The period of right of withdrawal starts on the day the contract is established for contracts regarding the performance of services; and on the day the consumer or a third party determined by the consumer receives the goods for contracts regarding the delivery of goods. However, the consumer may also exercise his right of withdrawal during the period from the establishment of the contract to the delivery of the goods.

In case the right of withdrawal is exercised, the delivery costs for returns to be made with a carrier company other than the carrier specified in this contract shall be the BUYER.

PERIOD OF THE RIGHT OF WITHDRAWAL:

If the Buyer is purchasing a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the service begins with the consumer's consent before the expiration of the right of withdrawal period.

The costs incurred in exercising the right of withdrawal are the responsibility of the SELLER.

In order to exercise the right of withdrawal, a written notification must be sent to the SELLER by registered mail, fax or e-mail within 14 (fourteen) days and the product must not have been used within the framework of the "Products for which the Right of Withdrawal Cannot Be Used" provisions set out in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

The invoice for the product delivered to a third party or the BUYER (If the invoice for the product being returned is from a corporate entity, it must be sent along with the return invoice issued by the institution. Returns of orders with invoices issued to corporate entities will not be processed unless a RETURN INVOICE is issued.)

The return form must be returned complete and undamaged, along with the box, packaging, and any standard accessories.

RETURN CONDITIONS:

The SELLER is obligated to return the total price and any documents binding the BUYER to the BUYER within 10 days of receiving the notice of withdrawal, and to accept the return of the product within 20 days.

If the value of the goods decreases due to a fault on the part of the BUYER, or if return becomes impossible, the BUYER is obligated to compensate the SELLER for losses incurred to the extent of the BUYER's fault. However, the BUYER is not responsible for any changes or deterioration resulting from improper use of the goods or product during the right of withdrawal period.

If the amount falls below the campaign limit set by the SELLER due to the exercise of the right of withdrawal, the discount amount offered under the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

Underwear, swimsuits, and bikini bottoms, makeup, disposable products, products that are prepared at the BUYER's request or clearly for their personal needs and are not suitable for return; products that are at risk of rapid deterioration or expiration; products that are unsuitable for return due to health and hygiene reasons if the BUYER opens the packaging after delivery; products that are mixed with other products after delivery and cannot be separated by their nature; and goods related to periodicals such as newspapers and magazines, other than those provided under a subscription agreement.According to the Regulation, it is not possible to return services performed instantly electronically or intangible goods delivered immediately to the consumer, audio or video recordings, books, digital content, software programs, data recording and storage devices, and computer consumables if the packaging has been opened by the BUYER. Furthermore, according to the Regulation, it is not possible to exercise the right of withdrawal for services whose performance began with the consumer's consent before the expiration of the right of withdrawal period.

In order for cosmetics and personal care products, underwear, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridges, ribbons, etc.) to be returned, their packaging must be unopened, untested, undamaged, and unused.

DEFAULT AND LEGAL CONSEQUENCES

The BUYER acknowledges, declares, and undertakes that, if payment is made by credit card and falls into default, the BUYER will pay interest and be liable to the bank in accordance with the credit card agreement between the cardholder and the bank. In such a case, the relevant bank may take legal action and claim any costs and attorney fees from the BUYER. Under all circumstances, if the BUYER defaults on a debt, the BUYER agrees to pay the SELLER any losses and damages incurred by the SELLER due to the delayed payment of the debt.
